These Terms of Service (“Terms”) govern your access to and use of the Better Peers platform operated by Better Peers, LLC (“Better Peers,” “we,” “us,” or “our”).
By accessing or using the platform, you agree to be bound by these Terms. If you do not agree, do not use the platform.
1. Eligibility
You must be at least 18 years old to create an account or use Better Peers. By using the platform, you represent and warrant that you meet this requirement and have the legal capacity to enter into this agreement.
2. Nature of the Platform
Better Peers is a technology infrastructure platform that facilitates reciprocal peer coaching coordination between independent members.
We provide directory and member discovery tools, session request and coordination functionality, session logging tools for personal documentation, subscription management, and technical support for platform functionality.
Better Peers does not provide coaching services.
3. No Coaching Services; No Professional Oversight
Better Peers does not provide coaching services, supervise, monitor, or evaluate coaching sessions, guarantee coaching outcomes, certify or validate logged hours, endorse credentialing bodies including the International Coaching Federation (ICF), EMCC Global, or the Association for Coaching (AC), act as an agent of any professional organization, or mediate disputes between members.
All peer coaching interactions occur independently between members.
4. Independent Member Status
Members are independent users of the platform and are not employees, agents, representatives, or partners of Better Peers. Better Peers is not a party to coaching relationships formed between members.
5. Member Responsibilities
You are solely responsible for conducting sessions, scheduling and communication, confirming professional credential requirements with your chosen accreditation body, adhering to applicable professional standards, and maintaining accurate profile information.
Session logging is for personal documentation only and is not verified or certified by Better Peers.
6. User Content
Members may input content including profile information and session notes (“User Content”).
You retain ownership of your User Content. By submitting User Content, you grant Better Peers a limited license to store, process, and display such content solely for platform functionality.
You are responsible for the legality and accuracy of User Content. You agree not to upload unlawful, defamatory, infringing, or sensitive information that you do not have the right to share.
Better Peers does not monitor session content and is not responsible for User Content.
7. Privacy
Your use of the platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
8. Payments and Subscriptions
Access requires a paid subscription. Subscriptions bill monthly, renew automatically unless cancelled, and are non refundable for partial periods. We may modify pricing with 30 days notice.
9. Account Security
You are responsible for maintaining the confidentiality of your login credentials. You must notify us immediately of unauthorized access.
10. Platform Modifications
We may modify, suspend, or discontinue features at any time. We are not liable for changes to platform functionality.
11. Limitation of Liability
To the fullest extent permitted by law, Better Peers shall not be liable for member conduct, coaching session quality or outcomes, credential acceptance decisions by any accreditation body, disputes between members, or indirect, incidental, consequential, or punitive damages.
In no event shall our total liability exceed the total subscription fees paid by you in the 12 months preceding the claim.
Some jurisdictions do not allow certain limitations. In such cases, liability is limited to the maximum extent permitted by law.
12. Disclaimer of Warranties
The platform is provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non infringement. We do not guarantee uninterrupted or error free service.
13. Indemnification
You agree to indemnify and hold harmless Better Peers, LLC from claims, damages, losses, or expenses arising from your use of the platform, your coaching activities, your User Content, or your violation of these Terms.
14. Force Majeure
We are not liable for delays or failures resulting from causes beyond our reasonable control, including acts of God, internet outages, government actions, or third party service failures.
15. Dispute Resolution
These Terms are governed by the laws of the State of Missouri, United States. Any dispute shall first be attempted to be resolved through good faith negotiation. If unresolved, disputes shall be resolved by binding arbitration administered by the American Arbitration Association. You waive the right to participate in class actions or class wide arbitration.
For users located in the European Union or United Kingdom, mandatory consumer protection laws in your jurisdiction may apply.
16. Termination
We may suspend or terminate accounts for violations of these Terms or harmful conduct. You may terminate your account at any time.
17. Electronic Communications
By using the platform, you consent to receive communications electronically, including service notices and legal updates.
18. Severability
If any provision is found unenforceable, the remaining provisions remain in effect.
19. Changes to Terms
We may update these Terms. Continued use after changes constitutes acceptance.
